Terms of Service

These terms are the agreement between you and me for using Ambio Reader (the "App"). Please read them — by creating an account or using the App you accept them. If you don't agree, please don't use the App. In these terms "I", "me" and "my" refer to Jakub Świerlikowski IT Services — my business details and contact are in section 16.
1. What Ambio Reader is
Ambio Reader is an ebook reader for iOS and Android. You import your own ebook files, and when you choose to analyze a book, the App uses automated analysis (including AI models run by third-party providers) to match ambient sounds and music to the scenes you read.
2. Who can use it
You must be at least 18 years old. You need an account, and you are responsible for keeping your sign-in details secure and for what happens under your account. Please give accurate information and keep your email address up to date.
3. Subscriptions
Plans and payment
The App is available by subscription, monthly or yearly. Subscriptions are sold and billed by Apple (App Store) or Google (Google Play), in your local currency, at the price shown in the App before you buy. The store's terms of sale apply to the purchase.
Automatic renewal
A subscription renews automatically at the end of each billing period and is charged to your store account, unless you cancel at least 24 hours before the period ends.
Free trial
Some plans include a free trial. Whether a trial is offered, and how long it lasts, is shown in the App before you subscribe; the store decides eligibility, usually one trial per store account. During the trial you get 3 classic books ready in your library, plus the first 30 pages of one book of your choice. Unless you cancel at least 24 hours before the trial ends, the subscription starts and is charged automatically.
Monthly page allowance
An active subscription lets you analyze up to 15,000 pages per billing month. A page is counted as 1,800 characters of the book’s text (including spaces), and each book is rounded up to whole pages. In this count a Chinese or Japanese character counts as 3.5 characters and a Korean syllable as 2, and invisible formatting marks don't count. The allowance renews at the start of each billing month (for yearly plans, each month of the subscription year); unused pages do not carry over. A book longer than the pages you have left that month can be analyzed once the allowance renews. A book you have already analyzed does not count again. A single book may be up to 10 million characters. Reading books you have already analyzed is not limited.
Cancelling
Cancel in the App (Settings → Manage Subscription) or in your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period, and you keep access until then. Uninstalling the App or deleting your account does not cancel a subscription.
Refunds and your statutory rights
Because Apple and Google sell the subscription, refund requests go to them: Apple or Google Play, under their policies. Nothing in these terms limits your statutory rights as a consumer, including any right of withdrawal and your rights if the App does not work as described. If something is wrong, please also write to me — I want to fix it.
Price changes
I may change subscription prices for future billing periods. You will be told in advance through the App Store or Google Play and, where the law requires, asked to agree; if you don't, you can cancel before the new price applies.
4. Your books
You may only import books you own or have the right to use — for example, DRM-free books you bought or books in the public domain. Do not import pirated copies.
Your books stay yours. When you choose to analyze a book, you give me a limited, non-exclusive, royalty-free licence to store, copy, transmit to my service providers, and analyze its text, only as needed to provide the App. The resulting analysis (scene boundaries, short scene descriptions, matched sounds and short excerpts marking where scenes start) is stored in a shared cache linked to a fingerprint of the book, not to you, so the same book isn't analyzed twice; that cached analysis may be kept after you delete your account. Details are in the Privacy Policy.
You are responsible for the books you import. If a claim is made against me because you imported a book you had no right to use, you agree to cover the resulting costs, to the extent the law allows.
5. Sounds and music
The sound effects, soundscapes and music in the App are owned by me or my licensors and are licensed to you only for listening inside the App. You may not extract, copy, record, redistribute or use them outside the App.
6. Automated matching
Sound matching is automatic and will sometimes be imperfect — a sound may not fit a scene. That is a limitation of the feature, not a defect I promise to eliminate. If a match is clearly wrong, tell me; those reports improve it.
7. Your licence to use the App, and fair use
I give you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own non-commercial use, under these terms and the rules of the store you downloaded it from. You agree not to:
- copy, modify, decompile or reverse engineer the App, except where the law allows it;
- get around the subscription, the free trial, the monthly allowance, or any access or content-protection measure;
- use bots, scripts or automated tools to access the App or its servers, or send an unreasonable volume of requests;
- resell, share or rent your account or access to the App;
- use the App to break the law or infringe anyone's rights.
8. Feedback
If you send me ideas or suggestions, I may use them to improve the App without owing you anything. You keep any rights you have in what you wrote.
9. Availability and changes to the App
I work to keep the App available, but it depends on servers and third-party services and may occasionally be interrupted, for example for maintenance or during a provider outage. New book analyses may be paused temporarily; books you have already analyzed keep working. I may improve and change features. If I make a change that significantly reduces what your subscription offers, I will tell you in advance and you can cancel.
10. Suspension and termination
You can stop using the App and delete your account at any time (Settings → Delete Account). I may suspend or close an account that seriously or repeatedly breaks these terms — for example piracy, abuse of the servers, or circumventing payment. Except where the breach is serious or the law requires otherwise, I will warn you first and give you a chance to fix it.
11. Liability
I provide the App with reasonable care and skill. To the extent the law allows, I am not liable for indirect or consequential losses, or for losses caused by events outside my reasonable control. Nothing in these terms limits liability that cannot be limited by law, including liability for intentional harm or gross negligence, or your statutory rights as a consumer.
12. App Store and Google Play
These terms are between you and me, not Apple or Google. I — not Apple or Google — am responsible for the App and its content, for maintenance and support, and for handling any claims about the App (including product liability, failure to meet legal or regulatory requirements, consumer-protection claims, and claims that the App infringes someone's intellectual property). Apple and Google have no obligation to provide maintenance or support for the App. If the App fails to conform to any applicable warranty (in the EU, this includes the legal guarantee that digital content and services conform to the contract), you may notify the store, which may refund the purchase price under its policies; to the extent the law allows, the store has no other warranty obligation. This does not limit your statutory rights against me if the App does not conform to our contract. You confirm you are not in a country under a US government embargo or listed as a "terrorist supporting" country, and not on a US list of prohibited or restricted parties. You must also follow any third-party terms that apply when using the App (such as your mobile data plan). Apple and its subsidiaries, and Google, are third-party beneficiaries of these terms and may enforce them against you.

How I handle personal data is described in the Privacy Policy.
14. Changes to these terms
I may update these terms, for example when the App or the law changes. The date at the top shows the current version. For significant changes, the App will ask you to accept the new terms; if you don't, you can cancel your subscription and stop using the App.
15. Law and disputes
These terms are governed by Polish law. If you are a consumer living in another EU country, you also keep the protection of the mandatory consumer laws of that country, and you can bring a claim in the courts of Poland or of the country where you live. If you have a problem, please contact me first — most things can be sorted out quickly by email.
